<p>What is needed is called a business succession plan and the value and legal structure of the business, as well as your time frame, can dramatically effect what this plan will look like once completed. Also the ability and desire of the person receiving the business is a factor.</p>
<p>The first step in drafting the plan is to assemble your team. This should include your attorney, CPA and financial planner. Together the team can begin to value the business, which usually involves a specialized appraisal.</p>
<p>After a proper value is determined, many small businesses have used incorporation or a Family Limited Partnership (FLP) to accomplish handing over the business. Either form can establish voting and non-voting shares or interests.</p>
<p>The business owner can then gift or sell the non-voting shares or interests to the receiver at a pace that is efficient for both the tax considerations and the training of the receiver who is to assume control of the business.</p>
<p><strong>Special note:</strong> If you are gifting rather than selling, make sure the children really WANT the business. You’ve worked too hard to turn over these assets to a less-than-willing receiver..</p>
